Carrying of Firearms-New Mexico

In New Mexico, carrying of a concealed loaded firearm or any other type of deadly weapon anywhere is considered as unlawful carrying.  There are some exceptions to this rule of unlawful carrying of a deadly weapon, and following are the exceptions[i]:

  • Carrying in the person’s residence or on real property belonging to him/her as owner, lessee, tenant or licensee;
  • Carrying in a private automobile or other private means of conveyance, for lawful protection of the person’s or another’s person or property;
  • Carrying by a peace officer in accordance with the policies of his/her law enforcement agency who is certified pursuant to the Law Enforcement Training Act;
  • Carrying by a peace officer in accordance with the policies of his/her law enforcement agency who is employed on a temporary basis and successfully completed a course of firearms instruction;
  • Carrying by a person in possession of a valid concealed handgun license issued to him/her by the department of public safety pursuant to the provisions of the Concealed Handgun Carry Act.

Likewise, it is permitted to carry any unloaded firearm anywhere.  It is a petty misdemeanor to unlawfully carry a deadly weapon.[ii].

Generally, carrying of a deadly weapon on school premises is prohibited, however, certain individuals listed below are allowed to carry deadly weapon in school premises[iii].

  • A peace officer;
  • School security personnel;
  • A student, instructor or school authorized personnel engaged in army, navy, marine corps, air force reserve officer;
  • A person conducting or participating in a school approved program, involving the carrying of a deadly weapon;
  • A person older than 19 years of age on school premises in a private automobile or other private means of conveyance, for lawful protection of the person’s or another’s person or property.

It is unlawful for any person without prior approval from the company to board or attempt to board a bus while in possession of a firearm.  Any person who boards a bus with a firearm is guilty of misdemeanor.  However, it does not apply to duly elected or appointed law enforcement officers or commercial security personnel in the lawful discharge of their duties[iv].

New Mexico recognizes permits to carry firearms from Alaska, Arizona, Colorado, Delaware, Florida, Kentucky, Michigan, Minnesota, Missouri, Montana, North Carolina, North Dakota, Ohio, Oklahoma, South Carolina, Tennessee, Texas, Utah, Virginia, and Wyoming.  The states that recognize permits to carry firearms from New Mexico are Alaska, Arizona, Colorado, Florida, Idaho, Indiana, Kansas, Kentucky, Michigan, Minnesota, Missouri, Montana, North Dakota, Oklahoma, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, and Wyoming.  The Department of Public Safety issues the permit to carry firearms.  Cost of the initial permit is $100 and fingerprint fee has to be paid additionally.  The permit is issued for a term of four years and $75 has to be paid for renewal.
