Carrying of Firearms-North Carolina

In North Carolina (N.C.), it is unlawful for any person to carry a concealed weapon willfully and intentionally except when the person is on his/her own premises.  It is also unlawful for any person to carry a concealed pistol or gun willfully and intentionally except in the following circumstances[i]:

  • The person is on his/her own premises;
  • The deadly weapon is a handgun, and the person has a concealed handgun permit or is a military permittee.

The restriction on carrying concealed weapons is not applicable to the following persons:

  • Officers and enlisted personnel of the armed forces of the U.S. when in discharge of their official duties;
  • Civil and law enforcement officers of the U.S.;
  • Officers and soldiers of the militia and the National Guard when called into actual service;
  • Officers of the state, county, city, town, or company police agency when acting in the discharge of their official duties;
  • Law enforcement officers, when not in duty.  Such officer should not carry a concealed weapon while consuming alcohol or an unlawful controlled substance or if the same remains in the officer’s body.

According to N.C. General Statute Section 14-269.3, it is unlawful to carry any gun, rifle, or pistol into any assembly where a fee has been charged for admission, or to any establishment in which alcoholic beverages are sold and consumed.  If a person violates Section 14-269.3 s/he will be guilty of Class 1 misdemeanor[ii].

Following persons are exempted from application of N.C. General Statute Section 14-269.3.

  • A person exempted from the provisions of Section 14-269;
  • The owner or lessee of the premises or business establishment;
  • A person participating in the event is carrying a gun, rifle, or pistol with the permission of the owner, lessee, or person or organization sponsoring the event;
  • A person registered or hired as a security guard by the owner, lessee, or person or organization sponsoring the event[iii].

North Carolina recognizes permits to carry firearms from Alabama, Alaska, Arkansas, Arizona, Colorado, Delaware, Florida, Georgia, Idaho, Indiana, Louisiana, Kansas,

Kentucky, Michigan, Mississippi, Missouri, Montana, New Hampshire, North Dakota, Ohio, Oklahoma, Pennsylvania, South Carolina, South Dakota, Tennessee, Texas, Utah, Virginia, Washington, and West Virginia.  The states that recognize permits to carry firearms from North Carolina are Alabama, Alaska, Arizona, Arkansas, Colorado, Delaware, Florida, Georgia, Idaho, Indiana, Kansas, Kentucky, Louisiana, Michigan, Mississippi, Missouri, Montana, New Hampshire, New Mexico, North Dakota, Ohio, Oklahoma, Pennsylvania, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, Washington, and West Virginia.  Permit is issued for a period of five years at a fee of $90.  Renewal fee for a permit is $85.  The issuing authority is county sheriff.
