Carrying of Firearms-Utah

In Utah, a person who carries firearm is guilty of a misdemeanor.  According to Section 76-10-504 of Utah Code Annotated, a person who carries a concealed dangerous weapon including an unloaded firearm on his/her person or in a way that it is readily accessible for immediate use which is not securely encased, or in a place other than the person’s residence, property, a vehicle in the person’s lawful possession, or a vehicle with the consent of the individual who is lawfully in possession of the vehicle, or business under the person’s control is guilty of a class B misdemeanor.

A person who carries a concealed dangerous weapon which is a loaded firearm is guilty of a class A misdemeanor.  If the concealed firearm is used in the commission of a violent felony and the person is a party to the offense, the person is guilty of a second degree felony[i].

A person may carry a loaded firearm in a vehicle only if the vehicle is in the person’s lawful possession, or the person is carrying it with the consent of the person lawfully in possession of the vehicle.  A person shall not carry a loaded firearm unless authorized by law on a public street, or in a posted prohibited area[ii].  Any person who carries a dangerous weapon while under the influence of alcohol or a controlled substance is guilty of a class B misdemeanor[iii].

Utah recognizes permits to carry firearms from all states.  The states which recognize permits to carry firearms from Utah are Alabama, Alaska, Arizona, Arkansas, Colorado, Delaware, Florida, Georgia, Idaho, Indiana, Kentucky, Louisiana, Michigan, Minnesota, Mississippi, Missouri, Montana, New Hampshire, New Mexico, North Carolina, North Dakota, Ohio, Oklahoma, Pennsylvania, South Dakota, Tennessee, Texas, Vermont, Virginia, Washington, West Virginia, and Wyoming.  The permit is issued for a term of five years at a fee of $59.
