According to Article 1, Section 20 of the Delaware Constitution, a person has the right to keep and bear arms in self defense or in defense of family, home and state. Delaware state permit is not required to purchase rifles, shotguns, handguns or long guns.
Delaware permits purchase and transportation of rifles or shotgun from a state contiguous to Delaware. The purchaser should be at least 18 years to buy a rifle or shotgun, and at least 21 years to buy a handgun. When a person purchases a firearm from a licensed dealer, criminal history record check and an involuntary commitment of an adult record check is required. However, purchasers of shotguns and antique firearms or replicas of antiques are exempted from the background check. The laws governing firearms are stated under 11 Del. C. § 1441 et seq.
