According to Article 1, Section 32, of the Indiana Constitution, people have the right to bear arms for self defense and in defense of the State. According to Indiana Code Section 35-47-2.5-3, when a person purchases a handgun from a dealer s/he should complete and sign Bureau of Alcohol, Tobacco, Firearms and Explosives Form 4473. Under Section 35-47-2.5-4, upon the dealer’s initiative, the buyer’s background check will be conducted by the National Instant Criminal Background Check System (NICS) maintained by the Federal Bureau of Investigation. Under Section 35-47-2.5-5, the buyer will have to produce a proof of personal identification and residence in Indiana. The proof should be a photographic identification form issued by any of the following:
- a governmental agency of the state or
- the United States Department of Defense, or
- other documentation of residence.
