Sale of Firearms-Guam

Gun law in the United States is defined by a number of state and federal statutes.  Sale or delivery of firearms is restricted in Guam like any other U.S. state.  In almost all the states of the US, an importer, manufacturer, dealer or collector shall be licensed under the Federal Gun Control Act of 1968 to be a lawful seller.

10 GCA § 60102 of the Guam Code deals with the ownership of certain prohibited firearms.  Guam prohibits the manufacture, possession, sale, barter, trade, gift, transfer or acquisition of any machine guns, sub-machine guns, automatic rifles or any other firearm.[i]  However, this restriction is not applicable to a rifle having a barrel length of sixteen (16) inches or greater or not a shotgun having a barrel length of eighteen (18) inches or greater or a revolver or pistol having a barrel length of more than twelve (12) inches.  Mufflers, silencers or devices for deadening the sound of discharged firearms are also prohibited.  Any person violating this Section shall be guilty of a felony which shall be punishable for a term of imprisonment of not less than three (3) years and a fine of not less than One Thousand Dollars ($ 1,000).[ii]

Section 60104 of the Guam Code deals with registration of firearms.  The law in Guam mandates all person in the business of selling, buying, renting or trading any firearm to register with the Department of Revenue and Taxation before engaging in any such activity.[iii]  The law also requires that in case of loss, theft, sale or transfer of a firearm
the registered owner should within three working days report the incident to the Guam Police Department.[iv] 

The law also requires that for a person to sell firearm to another, the buyer should show the seller an identification card evidencing the receiver’s right to own, possess, use and carry such firearm.[v]  It is unlawful for a person to transact a private sale, loan, gift or transfer of firearm without having seen the valid identification card of the person receiving the firearm.
