Gun law in the United States is defined by a number of state and federal statutes. Sale or delivery of firearms is restricted in Montana like any other U.S. state. In almost all the states of the US, an importer, manufacturer, dealer or collector shall be licensed under the federal Gun Control Act of 1968 to be a lawful seller.
Rules in the state of Montana insists that a firearm manufactured or sold in Montana under must have the words “Made in Montana” clearly stamped on a central metallic part, such as the receiver or frame[i].
In a products liability action, no firearm or ammunition may be considered defective in design on the basis that the benefits of the product do not outweigh the risk of injury posed by its potential to cause serious injury, damage, or death when discharged. For the purpose the following conditions are to be fulfilled:
- the potential of a firearm or ammunition to cause serious injury, damage, or death when discharged does not make the product defective in design; and
- injuries or damages resulting from the discharge of a firearm or ammunition are not proximately caused by its potential to cause serious injury, damage, or death but are proximately caused by the actual discharge of the product.
However, the above conditions do not affect a products liability cause of action based upon the improper selection of design alternatives[ii].
