Sale of Firearms-North Dakota

Gun law in the United States is defined by a number of state and federal statutes.  Sale or delivery of firearms is restricted in North Dakota like any other U.S. state.  In almost all the states of the US, an importer, manufacturer, dealer or collector shall be licensed under the federal Gun Control Act of 1968 to be a lawful seller.

As per the laws of North Dakota, a firearm manufacturer, distributor, or seller who lawfully manufactures, distributes, or sells a firearm is not liable to any person or to the estate, a successor, or survivor of any person for any injury suffered, including wrongful death and property damage, because of the use of a firearm by another.

An association of persons who are licensed under section 923 of title 18 of the United States Code, or amendments thereto, is not liable to any person for any injury suffered, including wrongful death and property damage, because of the use of a firearm sold or manufactured by any licensee who is a member of the association.  However, this does not apply to a claim for relief for deceit, breach of contract, express or implied warranty, or for injury resulting from failure of a firearm to operate in a normal or usual manner due to defects or negligence in design or manufacture[i].

In North Dakota, a person is guilty of an offense if the person knowingly supplies a firearm, ammunition, or explosive material to, or procures or receives a firearm, ammunition, or explosive material for, a person prohibited from receiving it[ii].
