Sale of Firearms-Utah

Gun law in the United States is defined by a number of state and federal statutes.  Sale or delivery of firearms is restricted in Utah like any other U.S. state.  In almost all the states of the U.S., an importer, manufacturer, dealer or collector shall be licensed under the Federal Gun Control Act of 1968, to be a lawful seller.

According to Utah Code Ann. § 76-10-526, criminal history background check is required for the sale of a firearm by a licensed firearm dealer in the state.  The firearms dealer has to forward all fees collected for criminal history background checks performed during the month to the division by the last day of the month following the sale of a firearm.

Utah Code Ann. § 78B-4-511 states that a person who lawfully designs, manufactures, markets, advertises, transports, or sells firearms or ammunition to the public may not be sued by the state or any of its political subdivisions for the subsequent use, whether lawfully or unlawfully, of the firearm or ammunition, unless the suit is based on the breach of a contract or warranty for a firearm or ammunition purchased by the state or political subdivision.

It is unlawful in Utah to sell any firearm to a minor less than 18 years of age unless the minor is accompanied by a parent or guardian.
